Rome II, Romanian and Lithuanian versions: does Article 15 describe the same matters as the other versions?

In Article 15(d) the Romanian text speaks of protective measures where the other versions speak of the measures a court may take to prevent or stop injury or damage. In Article 15(h) the Lithuanian text names acquisitive prescription, which concerns property, beside the limitation of actions.

Consequence

The matters governed by the applicable law are described differently in these two versions.

Proposed correction

The lawyer-linguists could say whether the wording should be aligned with the other versions: align Romanian Article 15(d) and Lithuanian Article 15(h) with the other versions.

Roma II, rumunų ir lietuvių kalbų versijos: ar 15 straipsnyje aprašomi tie patys klausimai kaip kitose versijose?

15 straipsnio d punkte rumunų tekste kalbama apie apsaugos priemones, o kitose versijose – apie priemones, kurių teismas gali imtis, kad užkirstų kelią pažeidimui ar žalai arba nutrauktų pažeidimą ar žalos darymą. 15 straipsnio h punkte lietuvių tekstas šalia ieškinio senaties nurodo įgyjamąją senatį, kuri susijusi su nuosavybe („įgyjamosios senaties ir ieškininės senaties“).

Consequence

Taikytinos teisės reglamentuojami klausimai šiose dviejose versijose aprašyti skirtingai.

Teisininkai lingvistai galėtų nurodyti, ar formuluotę reikėtų suderinti su kitomis kalbinėmis versijomis: suderinti rumunų teksto 15 straipsnio d punktą ir lietuvių teksto 15 straipsnio h punktą su kitomis versijomis.

La articolul 15 litera (d), textul român vorbește despre „măsurile asigurătorii”, în timp ce celelalte versiuni vorbesc despre măsurile pe care o instanță le poate lua pentru a preveni sau a face să înceteze vătămarea sau prejudiciul. La articolul 15 litera (h), textul lituanian menționează prescripția achizitivă, care privește proprietatea, alături de prescripția extinctivă.

Juriștii-lingviști ar putea preciza dacă formularea ar trebui aliniată cu celelalte versiuni lingvistice: alinierea articolului 15 litera (d) din versiunea română și a articolului 15 litera (h) din versiunea lituaniană cu celelalte versiuni.
