Rome II, Croatian and Slovenian versions: must all the parties pursue a commercial activity for a choice under Article 14(1)(b)?

The other versions allow a freely negotiated choice before the event where all the parties pursue a commercial activity. The Croatian and Slovenian texts say both parties.

Consequence

With three or more parties, the Croatian and Slovenian texts do not say whether every party must pursue a commercial activity.

Proposed correction

The lawyer-linguists could say whether the wording should be aligned with the other versions: say all the parties in Croatian and Slovenian Article 14(1)(b).

Rim II, hrvatska i slovenska verzija: moraju li sve stranke obavljati poslovnu djelatnost za izbor prava prema članku 14. stavku 1. točki (b)?

Druge verzije dopuštaju slobodno ugovoren izbor prava prije nastanka događaja ako sve stranke obavljaju poslovnu djelatnost. Hrvatski i slovenski tekst govore o objema strankama („obje stranke“, „obe stranki“).

Consequence

Kad postoje tri ili više stranaka, hrvatski i slovenski tekst ne navode mora li svaka stranka obavljati poslovnu djelatnost.

Proposed correction

Pravnici lingvisti mogli bi reći treba li tekst uskladiti s drugim jezičnim verzijama: navesti sve stranke u članku 14. stavku 1. točki (b) hrvatske i slovenske verzije.
