Rome II, Bulgarian and Slovenian versions: does Article 6(3)(b) set the same conditions as the other versions?
Article 6(3)(b) lets the claimant rely on the law of the court where the market is affected in more than one country, if the market in that Member State is directly and substantially affected. The Bulgarian text says more than one Member State; the Slovenian text says directly or substantially.
Consequence
A claim about a market affected in one Member State and a third country can use the option in most versions but not in Bulgarian; an indirect but substantial effect is enough in Slovenian.
Proposed correction
The lawyer-linguists could say whether the wording should be aligned with the other versions: align Bulgarian and Slovenian Article 6(3)(b) with the other versions.

Рим II, българска и словенска версия: поставя ли член 6, параграф 3, буква б) същите условия като другите версии?
Член 6, параграф 3, буква б) позволява на ищеца да се позове на правото на сезирания съд, когато пазарът е засегнат в повече от една държава, ако пазарът в тази държава-членка е засегнат непосредствено и значително. Българският текст гласи „повече от една държава-членка“; словенският текст гласи непосредствено или значително.
Consequence
При иск относно пазар, засегнат в една държава-членка и в трета държава, ищецът може да се възползва от тази възможност според повечето версии, но не и според българската; в словенската версия е достатъчно непряко, но значително въздействие.
Proposed correction

Člen 6(3)(b) tožeči stranki omogoča, da se opre na pravo sodišča, kadar je trg prizadet v več kot eni državi, če je trg v tej državi članici neposredno in bistveno prizadet. Bolgarsko besedilo navaja več kot eno državo članico; slovensko besedilo navaja „neposredno ali bistveno prizadeti“.
