Rome II, Croatian version: Articles 5(1) and 9 refer to Article 42(2), and Rome II has 32 articles

The other versions of Article 5(1) (product liability) and Article 9 (industrial action) begin without prejudice to Article 4(2), the rule on common habitual residence. The Croatian text refers to Article 42(2). There is no Croatian corrigendum to Rome II.

Consequence

In the Croatian text, the priority of the common habitual residence of the parties in product liability and industrial action cases is referred to an article that does not exist.

Proposed correction

Replace 42. with 4. in Croatian Article 5(1) and Article 9.

Rim II, hrvatska verzija: članak 5. stavak 1. i članak 9. upućuju na članak 42. stavak 2., a Rim II ima 32 članka

Ostale jezične verzije članka 5. stavka 1. (odgovornost za proizvode) i članka 9. (industrijska akcija) počinju upućivanjem koje znači „ne dovodeći u pitanje članak 4. stavak 2.”, odnosno pravilo prema kojem se primjenjuje pravo države u kojoj obje stranke imaju uobičajeno boravište.
