Rome I, Croatian version: does Article 8(2) on employment contracts apply in the absence of a choice of law, as in the other versions?

The other 23 versions open paragraph 2 with the absence of a choice by the parties. The Croatian opening repeats the condition of paragraph 3 and makes paragraph 2 depend on paragraph 2 itself. Croatian corrigenda 32008R0593R(04) and R(06) do not touch Article 8.

Consequence

For an employee who habitually works in one country under a contract without a choice of law, the Croatian text does not clearly state that the law of that country applies.

Proposed correction

The lawyer-linguists could say whether the wording should be aligned with the other versions: open Croatian Article 8(2) with the absence of a choice of law by the parties, as in the other versions.
