10 U.S.C. 4872(c)(3)(D): how should the exception for recycled tantalum, tungsten and molybdenum be reflected in contracts?

Section 844(a) of Public Law 119-60 added 4872(c)(3)(D): tantalum, tungsten, or molybdenum produced from recycled material, if the contractor demonstrates to the Secretary that the recycled material was produced outside a covered nation and melting and all further processing and manufacturing take place in the United States or in the country of a qualifying foreign government. When these conditions are met, the prohibition in 4872(a)(1) does not apply. The deviation and clause 252.225-7961 keep only the exception for recycled neodymium-iron-boron magnets. Case 2024-D014 includes this amendment. One reading lets a contractor that meets the statutory conditions rely on the exception now. The other keeps the clause restriction until the clause is amended, because the statutory exception does not by itself establish compliance with the contract.

Consequence

No contract or delivery affected by the difference has been established.

Proposed correction

Please clarify how this exception should be reflected in contracts pending completion of case 2024-D014.
