Molybdenum in 10 U.S.C. 4872(f)(1): what interim contract instructions apply while the DFARS definition is updated?

Public Law 119-60, section 844(a)(1), added molybdenum to the definition of covered material in 10 U.S.C. 4872(f)(1). The DFARS definition in 225.7018-1, the definition in Class Deviation 2026-O0041, Revision 1, and clause 252.225-7961 keep the five-material list without molybdenum. DFARS case 2024-D014 already covers this amendment. One view is that the statutory prohibition applies to DoD acquisitions of molybdenum now. The other is that contract obligations follow the clause list, which does not include molybdenum, until the case is completed.

Consequence

No delivery of molybdenum from a covered nation under a current contract has been established.

Proposed correction

Please clarify what interim contract instructions apply to the statutory restriction on molybdenum while case 2024-D014 is pending.
