Foreign-labour record rules (2018) put the reporting duty on the foreign employee; Article 8(3) of the Constitutional Statute, as amended in December 2019, names AIFC Participants and bodies

Article 8(3) of the Constitutional Statute, as amended by Constitutional Law No. 296-VI of 30 December 2019, requires Participants and bodies of the Centre to submit information on attracted foreign nationals to the AIFC Authority "in accordance with acts of the Centre". The only implementing act we found, AIFC Rules No. 2 of 2018 (rule 2.2), puts the duty on the Foreign Employee, who may file in person or through the Employer. The two duties can coexist, but we found no act of the Centre addressed to Participants and bodies. Rule 2.2 also uses "admit" where "apply" or "submit" seems meant.

Proposed correction

Please indicate the act of the Centre that implements the second paragraph of Article 8(3), or consider adding to the Rules a duty addressed to Participants and bodies of the Centre.
