ARXO-2026-0173 · Reported
Capital of Digital Asset Service Providers: DAA Table 2 and PRU (INV) Table 3.3 both apply to the same activities with different amounts
DAA 3.2(1)(b) and Table 2 set the capital of a Digital Asset Service Provider at USD 250,000 for Providing Custody, USD 100,000 for Managing Investments and USD 250,000 for Dealing in Investments as Principal (other than matched principal). PRU (INV) 1.3 applies to any firm authorised to conduct these activities; Investments include Digital Assets (Glossary), and PRU (INV) 1.3(6) does not exclude Digital Asset Business. PRU (INV) Table 3.3 sets USD 500,000 for Providing Custody Services and for Dealing in Investments as Principal and USD 150,000 for Managing Investments, with the liquid assets requirement in PRU (INV) 4. DAA 3.2(1)(a) keeps the general authorisation requirements of other applicable rules, and for stablecoin issuers DAA 4.2(b) states that "the highest amount applies" where another activity requires more capital, so the DAA amounts may be meant as a floor next to PRU (INV). The Rules do not say so for Table 2. Example: a firm licensed only to provide custody of Digital Assets with capital resources of USD 300,000 meets Table 2, but is USD 200,000 below PRU (INV) Table 3.3 for the same activity.
Proposed correction
Please state whether the DAA Table 2 amounts are meant to replace or to supplement PRU (INV) for Digital Asset Service Providers. If they replace it, PRU (INV) 1.3 could exclude Digital Asset Business; if PRU (INV) applies, Table 2 could say that the higher amount applies.
