ARXO-2026-0003 · Editorial note added

26 U.S.C. §42(e)(3)(B) refers to “subsection (b)(2)(B)(ii)”, which no longer exists

Section 42(e)(3)(B) sets the credit for certain rehabilitation expenditures “using the percentage applicable under subsection (b)(2)(B)(ii)”. Subsection (b)(2)(B) has had no clauses since P.L. 110-289 §3002(a) restructured subsection (b); the 30 percent rule is now in subsection (b)(1)(B)(ii). The reference was not conformed when subsection (b) was rewritten.

Proposed correction

Refer to subsection (b)(1)(B)(ii).
